The rules, rights, responsibilities, subscriptions, academic-integrity terms, AI disclaimers, and legal conditions for using Edvana.
Terms of Service
These Terms of Service ("Terms") govern your use of Edvana, an AI-powered study platform operated at edvana.ai by Edvana, a partnership registered in Australia under ABN 42 606 861 566 ("Edvana", "we", "us", "our").
By creating an account or using Edvana, you agree to these Terms. If you do not agree, do not use the service.

1. Eligibility
You may use Edvana if:
- you are at least 13 years old;
- if you are under 18 (or under the age of majority in your jurisdiction), you have permission from a parent, guardian, or your school; and
- you are legally able to enter into a binding contract under the laws that apply to you, or you are using the service through a school account that has been set up on your behalf.
Edvana is intended as a study tool for students of the International Baccalaureate Diploma Programme. You may use it for other purposes at your own risk and without warranty that it will be useful for those purposes.
2. Your account
You are responsible for:
- providing accurate registration information and keeping it up to date;
- keeping your password confidential and your account secure;
- all activity that occurs under your account, whether or not authorised by you; and
- notifying us promptly at support@edvana.ai if you suspect unauthorised use of your account.
You may not share your account, transfer it to anyone else, or use someone else's account.
3. Subscriptions, billing and refunds
(a) Free and paid plans. Edvana offers free features and paid subscription plans (currently "Pro" and "Max"). Plan features and pricing are described on edvana.ai and may change from time to time. Changes that increase the price of an existing subscription will not take effect until your next renewal and we will notify you in advance.
(b) Billing. Paid plans are billed in advance on a monthly basis (or other interval shown at checkout) in Australian dollars unless otherwise stated. Prices are inclusive of GST where applicable.
(c) Automatic renewal. Your subscription renews automatically at the end of each billing period at the then-current price for your plan, unless you cancel before the renewal date.
(d) Cancellation. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period — you keep access to paid features until then, and you are not charged again.
(e) Refunds. Subscription fees are generally non-refundable for partial billing periods. This does not limit your rights under the Australian Consumer Law (see Section 11) or other consumer protection laws that apply to you.
(f) Failed payments. If a payment fails, we may suspend or downgrade your access until payment is made. If we cannot collect payment after a reasonable period, we may terminate your subscription.
(g) School and institutional licences. If your access to Edvana is provided by a school, university, or other institution that has licensed Edvana on your behalf, your access is governed by the agreement between Edvana and that institution and may end when that agreement ends.
4. Acceptable use
You agree not to:
- use Edvana for any unlawful purpose or in violation of any applicable law or regulation;
- submit content that you do not have the right to submit (including content that infringes copyright, trade marks, or other intellectual property rights, or content that contains another person's personal information without their consent);
- attempt to reverse engineer, decompile, scrape, or otherwise extract source code, model weights, or training data from Edvana;
- use automated means (bots, scripts, scrapers) to access the service except for legitimate accessibility tools, or in a way that places unreasonable load on our infrastructure;
- attempt to circumvent rate limits, paywalls, or other access controls;
- attempt to compromise the security of Edvana, including by probing, scanning, or testing the vulnerability of any system or network without our prior written consent;
- use Edvana to harass, threaten, defame, or harm another person;
- use Edvana to generate content that depicts child sexual abuse, incites violence, or otherwise violates the law;
- attempt to manipulate, prompt-inject, or otherwise misuse the AI features to bypass safety measures or produce content that is not consistent with the intended educational purpose; or
- resell, rent, or otherwise commercially exploit Edvana or its outputs without our prior written consent.
We may suspend or terminate your account if you breach these rules, with or without notice depending on the seriousness of the breach.
5. Academic integrity — important
Edvana is a study tool. Submitting AI-generated content as your own original work is academic misconduct under IB rules and may also breach your school's academic honesty policy.
You acknowledge and agree that:
- (a) all final IB submissions — including extended essays, internal assessments, theory of knowledge essays, and any other assessed work — must be your own original work;
- (b) you are responsible for understanding and complying with the IB's academic honesty policies and your school's policies;
- (c) outputs from Edvana — including model essays, marked drafts, and example responses — are study aids only and must not be copied, paraphrased, or otherwise submitted as your own original work to the IB or to your school;
- (d) marks, grades, and feedback generated by Edvana are AI-generated estimates only. They are not official IB marks or predictions of IB marks, are not produced by IB examiners, and may be inaccurate; and
- (e) we do not guarantee that any particular use of Edvana is permitted under the IB's academic honesty policy or your school's policy. If in doubt, ask your teacher or DP coordinator before relying on outputs from Edvana in your work.
6. Intellectual property
(a) Your content. You retain ownership of the content you submit to Edvana ("Submitted Content"). By submitting content, you grant Edvana a worldwide, non-exclusive, royalty-free licence to host, store, transmit, process, and display that content for the purpose of providing the service to you. This licence ends when you delete the content or your account, except to the extent we are required to retain it under law (see our Privacy Policy, Section 10).
(b) AI outputs. Subject to these Terms and applicable law, you may use AI-generated outputs produced by Edvana in response to your prompts ("Outputs") for your personal, non-commercial study purposes. Other users may receive identical or similar Outputs in response to similar prompts; we make no claim of exclusivity over Outputs.
(c) Edvana's intellectual property. All rights in Edvana's software, design, branding, content (other than Submitted Content), and aggregated subject configuration, marking criteria, and study materials are owned by Edvana or our licensors and are protected by copyright and other intellectual property laws. Except for the rights expressly granted to you in these Terms, you have no rights in Edvana's intellectual property.
(d) Feedback. If you give us feedback or suggestions about Edvana, we may use that feedback without obligation or compensation to you.
(e) Third-party content. Edvana may incorporate or reference third-party materials (such as past paper formats, command terms, and assessment criteria published or used by the International Baccalaureate Organization). Such materials remain the property of their respective owners. Edvana is not affiliated with, endorsed by, or sponsored by the International Baccalaureate Organization.
7. AI features — disclaimers
Edvana's core features rely on third-party large language models. You acknowledge that:
- AI-generated outputs may be inaccurate, incomplete, outdated, or inconsistent — including answers to questions, marking, feedback, model essays, diagrams, and explanations;
- AI may produce content that appears confident but is wrong (sometimes called "hallucination");
- AI marking does not replicate official IB marking and may differ — sometimes significantly — from the marks an IB examiner would award;
- you should always verify Outputs against official IB resources and seek your teacher's guidance on important assessments;
- some features may be unavailable from time to time due to provider outages, rate limits, or changes by upstream model providers; and
- we may add, change, or remove AI features and switch model providers without notice, provided we make reasonable efforts to maintain feature parity for paid plans during a billing period.
8. Service availability and changes
We aim to keep Edvana available, but we do not guarantee uninterrupted or error-free operation. The service may be unavailable from time to time for maintenance, upgrades, or due to events beyond our reasonable control.
We may modify, suspend, or discontinue any part of the service at any time. If we discontinue a paid feature you were paying for during a billing period, we will refund a pro-rated amount of your subscription fee for the remainder of the period.
9. Termination
(a) By you. You may stop using Edvana at any time and delete your account through your account settings or by contacting support@edvana.ai.
(b) By us. We may suspend or terminate your account, with or without notice, if:
- you breach these Terms or our acceptable use policy;
- we are required to do so by law;
- continuing to provide the service to you would expose us to legal or security risk; or
- we cease to operate the service generally.
(c) Effect of termination. When your account is terminated, your right to use the service ends immediately. Sections that by their nature are intended to survive termination (including Sections 5, 6, 10, 11, 12, 13, and 14) will continue to apply.
10. Privacy
Our handling of your personal information is governed by our Privacy Policy, which forms part of these Terms.
11. Australian Consumer Law and consumer guarantees
Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law that cannot be lawfully excluded.
If you are a consumer under the Australian Consumer Law, our services come with guarantees that cannot be excluded — including guarantees that they will be provided with due care and skill, fit for a disclosed purpose, and provided within a reasonable time. If we breach a consumer guarantee, you may be entitled to a refund, replacement, or other remedy under the Australian Consumer Law.
For services that are not of a kind ordinarily acquired for personal, domestic, or household use or consumption, our liability for breach of a consumer guarantee is limited (where permitted by law) to, at our option, supplying the services again or paying the cost of having them supplied again.
12. Limitation of liability
Subject to Section 11 and to any other liability that cannot be excluded by law:
- (a) Edvana provides the service "as is" and "as available", and to the maximum extent permitted by law, we exclude all warranties, conditions, and representations not expressly stated in these Terms — including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement;
- (b) we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities arising out of or in connection with your use of the service;
- (c) we are not liable for any academic outcome, mark, grade, or assessment result, whether awarded by the IB, your school, or any other body;
- (d) we are not liable for the accuracy, completeness, or usefulness of any Output, or for any decision you make in reliance on an Output; and
- (e) our total aggregate liability to you for all claims arising out of or in connection with the service in any 12-month period is limited to the greater of (i) the amount you paid Edvana in the 12 months before the event giving rise to the claim, or (ii) AUD $100.
13. Indemnity
You agree to indemnify and hold harmless Edvana, its partners, employees, and agents from and against any claim, loss, damage, or cost (including reasonable legal fees) arising from:
- your breach of these Terms;
- your misuse of the service, including any submission of Outputs as your own original work in breach of academic honesty rules; or
- your infringement of any third party's rights.
This Section 13 does not apply to the extent that the claim, loss, damage, or cost arises from our negligence or wilful misconduct.
14. Governing law and disputes
These Terms are governed by the laws of New South Wales, Australia. The courts of New South Wales have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, except that we may bring proceedings in any jurisdiction where you are located in order to protect our intellectual property or enforce these Terms.
If you are a consumer, this clause does not affect any right you may have to bring proceedings in the courts of your country of residence.
Before commencing court proceedings, you agree to first contact us at legal@edvana.ai and attempt to resolve the dispute in good faith for at least 30 days.
15. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email and/or through the service at least 14 days before the changes take effect. If you do not agree to the changes, you must stop using the service before the changes take effect; continued use after the effective date constitutes acceptance.
16. General
(a) Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and Edvana about the service and supersede any prior agreement.
(b) No waiver. A failure by us to enforce any provision of these Terms is not a waiver of our right to enforce it later.
(c) Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions continue in full force.
(d) Assignment. You may not transfer or assign your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms (for example, to a successor entity in the event of a sale of the business).
(e) No agency. Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and Edvana.
(f) Force majeure. We are not liable for any failure to perform our obligations under these Terms to the extent that the failure is caused by an event beyond our reasonable control.
